Caro Manfredi,
quando il tardo pomeriggio di quella maledetta domenica, segnata dalla storia con la data del 19 luglio 1992, appresi dalla televisione della strage di via D'Amelio, la notizia non penetrò l'animo mio solo in termini d'intenso dolore, ma anche come un'atroce beffa che intuivo, ma che non riuscivo ad interpretare con la forza della ragione; era un sentire la beffa, un pensare di comprenderne le ragioni, che però non riuscivano a liberarsi dalla sensazione d'essere forzate dalle mie forti emotività.


Quel giorno, ebbi la tremenda paura, che "le difficoltà" della Procura di Palermo, con la morte di Tuo padre, potessero ritornare arrogantemente in scena.
Di quelle "difficoltà", che si evidenziavano ogni volta che il "modello produttivo" di Fincantieri e le compromissorietà criminali venivano messi in evidenza dalle denunce dello scrivente e dei propri compagni di lavoro, come in passato anche da altri attori dirigenziali e/o imprenditoriali, avevo avuto modo di parlarne, già nel mese di maggio del 1989 ed anche dopo, l'assemblea sciopero del 2 novembre dello stesso anno, organizzata dallo scrivente per denunciare la presenza criminale dentro lo stabilimento navale, con due Magistrati della Procura di Palermo, nei locali del "Coordinamento Anti-mafia "that they were sympathizers and I, a member of the Board.

Ma poi, a seguito delle dichiarazioni e dei nomi indicati dal "pentito" Francesco Onorato, quali indagini, che hanno dignità di tale definizione, ha fatto quel PM?..

Mi esposi alla querela perchè l'animo mio, intuiva già che, grazie "alle concezioni esecutorie della legge" a Caltanissetta avrei trovato la stessa accoglienza ,d'un cane che entra in chiesa durante la funzione religiosa: ma, lo scrivente aveva bisogno di capire.... a qualsiasi costo!...
In data 19 dicembre 2001, avevo già querelato il Magistrato, fonte dei miei legittimi sospetti, che aveva chiesto due ingiustificati rinvii a Giudizio contro lo scrivente per due querele infondate e uguali, formulate dallo stesso personaggio: ma, lui nella qualità d'imputato aveva facoltà di non rispondere e di non presenziare in sede giudiziaria.

A me riesce difficile pensare che le difficoltà d'ufficio, della D.ssa Silvana Saguto siano artatamente costituite per aiutare quel Magistrato che difese le debolissime ragioni, d'un imprenditore che si dice vittima innocente del racket mafioso. Però al di là della stima che nutriamo per le persone, dobbiamo ammettere che troppe volte la prudenza, è stata storicamente la peggiore nemica della verità.
La mia argomentata e documentata querela fu archiviata perchè le scelte investigative del Magistrato sono insindacabili, anche in presenza della testimonianza scritta d'un poliziotto che attesta cose diverse, che però i PM ed il GIP hanno giustificato accogliendo la tesi dell'imputato (il Magistrato in oggetto) che ha affermato di avermi detto quelle cose perchè è un mio amico, agganciandosi al fatto che ci diamo del tu...(sic.)
Non si volle indagare sui fatti da me esposti, anche in presenza di fatti gravissimi da me contestati al Magistrato in oggetto, in ordine a via D'Amelio, davanti al GIP.,
La querela, contro il mio comunicato stampa del 29 aprile 2002, che lui fu costretto a farmi dopo ben 83 giorni di riflessione (sic.), per la quale in sede istruttoria mi difesi attaccando (anche qui) in modo assai argomentato e documentato anche in ordine ai miei sospetti su via D'Amelio, sfociò in un Processo che mi vide imputato.
Le due PM che raccolsero le mie dichiarazioni, sia nella qualità di persona offesa che in quella d'imputato, non presenziarono mai al nostro confronto, sia davanti al GIP (tre udienze) che in sede Processuale, che vide anche in notevole difficoltà il Magistrato che poi ritirò la querela ...Mi chiedo: E possibile che, non volevano ascoltare e vedere?
Caro Manfredi, in ogni sede ed in ogni luogo ho sempre detto la verità: e quando, senza averlo espressamente richiesto, ho constatato la piena disponibilità del Magistrato (fonte principale del mio sospetto) a ritirare la querela ma, solo dopo che avesse avuto la certezza che avrei accettato la sua remissione, colsi la palla al balzo, sia perchè ero stanco della "concezione esecutoria" della Procura di Caltanissetta che alla luce dei fatti di mia conoscenza non ha mai indagato sulle cose che ho posto alla sua attenzione, sia per la funzione strategica che attribuivo alla querela: in sede Processuale avevo ascoltato abbastanza; anche cose non corrispondenti alla verità, dichiarate da quel Magistrato sotto giuramento; perchè dunque, non mettere, quello che oggi è un Sostituto Procuratore Generale a Palermo, nelle condizioni di chiudere in fretta un Processo che gli era scomodo, anche in funzione di parte offesa, evitandomi così, unfair, but certain conviction, at least until the Supreme Court? ... Queste non sono mie considerazioni; sono fatti resi evidenti dalla storia d'Italia.
In assenza di un cristallino chiarimento, le scelte investigative di quel Magistrato, unitamente a quelle di altri suoi colleghi, anche quì non menzionati per motivi strategici, paiono vestite con gli abiti delle omissioni che indicano inequivocabilmente quei "cerchi concentrici Istituzionali" che avrebbero "auspicato" la morte di tuo padre per rimuovere l'ostacolo che impediva alla Procura di Palermo di tornare a sbagliare con scandalosa indecenza, quel mese di luglio 1992.
Un movente, carico d'indizi e di fatti documentali, come quello prospettato dallo scrivente che si sposa con estrema naturalezza con altri inquietanti indizi: i cosiddetti misteri.
La borsa contenente l'agenda rossa; l'errore di aver arrestato Pietro Scotto (sic.) prematuramente bruciando le intercettazioni ambientali; la mancata perquisizione (sic.) del covo di Totò Riina; le convergenti dichiarazioni dei "pentiti" che indicano la giornata del 17 luglio 1992, come quella in cui fu dato l'ordine di uccidere Tuo padre e per questo fu preparata la Fiat 126, ed altri fatti non meno importanti, in altre circostanze avrebbero registrato il massimo impegno delle Istituzioni nel fare chiarezza.
A me piace ancora pensare che la Procura di Caltanissetta abbia sbagliato in buona fede: non voglio pensare cose tristi di quella Procura che non volle assolutamente dare conferma di ricevuta postale agli addetti delle poste, in ordine ad un mio corposo plico, inviato a mezzo raccomandata-assicurata, in data 19 dicembre 2003, che conteneva notizie interessantissime da includere, in ordine ai minimi fatti che avevo già posto alla loro attenzione ed a verbale il 24 novembre precedente, quando si dovette sospendere per altri impegni delle due PM: ma nemmeno questo sfrontato errore e/o messaggio psicologico di quella Procura, mi ha fatto fin qui paura....
Visitando la storia della nostra terra e le responsabilità e/o le difficoltà (sic.) che hanno visto protagoniste le Procure siciliane, (fermo restando il rispetto per l'Istituzione) mi sento nel diritto di non avere più incondizionata fiducia nelle persone di quella Procura della Repubblica: mi hanno trattato malissimo, sia a livello umano che in ordine alla mia credibilità. Così sono stato trattato io che, (posso gridarlo forte e sfido quei Magistrati a dimostrare il contrario) ho combattuto "cosa nostra" e la mafia senza motivi di rivalsa personale, senza doveri professionali (sic.), senza legittime o meschine finalità politiche e/o di potere, senza essere parente di alcuna vittima della mafia è sopra tutto, senza esser servo di alcun potere, ma fedele soldato della nostra Costituzione.
Quando ho appreso che il procedimento penale riguardante la strage di via D'Amelio era stato archiviato, nella qualità di persona offesa (perchè la mia morte civile iniziò subito dopo quella strage), ho chiesto di conoscerne i motivi, mi è stato risposto che avrei dovuto prima spiegare le motivazioni che mi vedevano parte lesa.
Consigliato dal mio avvocato ho deciso di desistere per i motivi che ti lascio interpretare, partendo dalla seguente e credo lucida considerazione: se si fossero fatte le minime indagini di rito, c'era motivo di chiedere a me i motivi che mi vedono parte offesa nella strage di via D'Amelio?... E là dove avessi prodotto istanza argomentata e ulteriormente documentata, quale speranza avrei avuto che la mia richiesta trovasse la dovuta attenzione in una Procura che non aveva fino ad allora, a mio avviso, prestato la benché minima attenzione alle cose ed ai fatti che ho denunciato alla stessa?..

L'anno successivo o più avanti nel tempo (non posso essere preciso perchè non ho ad immediata portata di mano i miei quaderni a futura memoria, constatato che, malgrado i forti elementi probatori e addirittura le prove che avevo prodotto,non si erano scalfivate per niente le relazioni "imprenditoriali" e i convenienti intenti fra azienda e "cosa nostra", mi recai nella Procura presso la Pretura di Palermo per chiedere notizie sull'esposto del 29 giugno 1992, al PM che mi era stato indicato dal Brigadiere della guardia di Finanza.

In buona sostanza, quel Processo svuotava l'importanza penale ed i profondi contenuti di quell'esposto, ed escludeva dal Processo anche in qualità di teste, l'estensore dello stesso che si dichiarava anche parte offesa, perchè avevo scoperta la verità, seguendo la rozza traccia della falsa testimonianza di Antonino Cipponeri nel mio Processo del lavoro.
Eppure, sia davanti al PM della Procura Antimafia di Palermo, sia davanti al Brigadiere della guardia di Finanza e sia nell'esposto, mi dichiaravi sempre parte offesa, per quel mentire sotto giuramento di Antonino Cipponeri, che poteva arrecarmi danni patrimoniali.
Nei documenti di questo sito web, puoi tu stesso constatare che concludevo l'esposto, dicendo che intendevo essere avvisato in caso di archiviazione... (sic.)

Nel secondo dopoguerra il Cantiere navale è in prima linea nella lotta contro la mafia che ha come protagonista il movimento contadino. Nel gennaio del 1947, l'anno più duro nello scontro con la mafia, al Cantiere navale i mafiosi, capeggiati dal boss dell'Acquasanta Nicola D'Alessandro, sparano sugli operai che non tollerano la presenza mafiosa nel Cantiere e chiedono l'allontanamento del direttore della mensa Emilio Ducci, appoggiato dai mafiosi.
